The personal information we collect or have about you will either be provided by you directly, come from other sources, or will be collected from your activity on our website or applications and use of the Service as set out below. We may use your friends' data to let you know what your friends are doing on our Service, and to let your friends know what you are doing on the Service. The data we receive is dependent upon your privacy settings with the social network, and we will not post information about you on third party social media sites without your consent. You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to our website or Service.

When other companies work with DuoPeak to utilize our services as a publishing and marketing agency, we receive a pre-determined set of non-identifiable data from them to inform business decisions regarding the products and services we have agreed to publish and market on their behalf. Address Book Information
With your permission, DuoPeak may access the contact list available on your mobile device or in your email accounts in order to locate your friends and contacts on the Service, and to invite your friends and contacts to connect with our Service. When you invite your friends to join the Service, we will include your name and photo to let them know that you are the person extending the invitation. After sending these invitations, we may also send reminder emails to your invitees on your behalf. We will store these contacts for the purpose of alerting you when your contacts join a DuoPeak service at a later time so that you may connect with them on the Service, and to suggest friends and connections to other members of DuoPeak products.
We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages and push notifications, and permit you to communicate with others on the Service or on social media or invite others to join the Service. We may combine information internally across different Service offerings or games to enhance your experience with our Service.
For example, we may identify a friend you may know from one service to suggest that you engage with that friend on another service, and we may let your friends on one service know about your activities on another service. For example, we may send an email to your friends on [game] to let them know that you're active on [game], and we may include your profile picture in the email so that your friends recognize you. We may also use information about your activities on the Service to provide personalized content, including targeted content and advertising. We may also send you Service-related emails or messages (e.g., account verification, account status, changes or updates to features of the Service, technical and security notices). To provide our games, websites and interest-based advertising, we use ad identifiers, cookies and similar technologies. This section describes our use of these technologies and how you can manage your preferences.
How do ad identifiers, cookies, and similar technologies work?
Ad identifiers are non-permanent identifiers such as the Android advertising ID and/or Apple’s ID for advertising (the ‘IDFA’), which are uniquely associated with your device. Similar technologies include tracking pixels within ads. Cookies are small text files that are stored by your browser on your desktop computer or mobile device.
When you access the Service, we collect certain technical information in order to (i) analyze the usage of our sites and Service; (ii) provide a more personalized experience; and (iii) manage advertising. We and service providers acting on our behalf, such as Google Analytics, will use Log Files and other tracking technologies to collect and analyze certain types of technical information over time and across different websites following your use of the Service, including cookies, WiFi information, IP addresses, geo-location, device type, device identifiers, browser types, browser language, referral and exit pages, and URLs, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, Service state and the date and time of activity on our Services, and other similar information. In some cases, we will associate this information with your user ID number for our internal use.
Do Not Track Disclosure
We also employ other technologies including (i) web beacons, which allow us to know if a certain page was visited or whether an e-mail was opened; (ii) tracking pixels, which allow us to advertise more efficiently by excluding our current users from certain promotional messages, identifying the source of a new installation or delivering ads to you on other websites; and (iii) local shared objects also known as flash cookies, which help us to prevent fraud, remember your in-Service preferences and speed up load times.
How to adjust your preferences for interest-based advertising
You can choose to prevent your device’s ad identifier being used for interest-based advertising, or you can reset your device’s ad identifier, by changing the settings of your device. Settings vary from device to device but you will usually find the ad identifier settings under “privacy” or “ads” in your device’s settings.
The NAI (Network Advertising Initiative) allows for the central opting out of all its members’ cookies from a single opt-out page. If you delete your cookies, use a different browser or buy a new computer, you will need to renew your opt-out choice.

This includes other companies owned by or under common ownership as DuoPeak, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns. Affiliated Marketing and Publishing Partners
This includes other companies working with DuoPeak to utilize our services as a publishing and marketing agency. We do not own or control these affiliated partners, but all affiliated companies agree to use your personal information in the same way as we can under this Policy.
We will share your personal data with our Affiliates including in the United States. Please be aware that the US and other jurisdictions may have a lower standard of data protection laws than your own jurisdiction. We will also share your personal data with third party recipients (i.e., parties other than DuoPeak Inc) including outside the European Economic Area, in the following circumstances:

Sale or Merger
In the event that the Company undergoes a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, we may transfer all of your information, including personal data, to the successor organization in such transition. In such cases, we will first notify you in accordance with local law requirements, if any, regarding those items of personal data that will be transferred, the name and contact details of the recipient, and inform you of how you can withdraw consent thereto.
Safety, security and compliance with law
Your information, and the contents of all of your online communications (including without limitation chat text, voice communications and IP addresses) may be accessed and monitored as necessary to provide the Service and may be disclosed: (i) when we have a good faith belief that we are required to disclose the information in response to legal process (for example, a court order, search warrant or subpoena); (ii) to satisfy any applicable laws or regulations; (iii) where we believe that the Service is being used in the commission of a crime, including to report such criminal activity or to exchange information with other companies and organizations for the purposes of fraud protection and credit risk reduction; (iv) when we have a good faith belief that there is an emergency that poses a threat to the health and/or safety of you, another person or the public generally; and (v) protect against harm to the rights, property or safety of DuoPeak, its users or the public as required or permitted by law and (vi) detect, prevent or otherwise address criminal (including fraud or stalking), security or technical issues.
We may also share information with others in an aggregated and anonymous form that does not reasonably identify you directly as an individual.
3. YOUR CHOICES REGARDING YOUR INFORMATION
Profile and Data Sharing Settings
You may change some of your data sharing preferences on the Settings page within the various apps and services provided by DuoPeak.
We may occasionally send you push notifications through our mobile applications to send you game updates, high scores, and other service related notifications that may be of importance to you. You may at any time opt-out from receiving these types of communications by turning them off at the device level through your settings.
If you do not wish to receive promotional emails, you can click the "unsubscribe" button on promotional email communications. Note that you are not permitted to unsubscribe or opt-out of non-promotional messages regarding your account, such as account verification, changes or updates to features of the Service, or technical and security notices.
We may permit third party online advertising networks, social media companies, and other parties to collect information about your use of our website and apps over time so that they may play or display ads that may be relevant to your interests on our Service as well as on other websites or apps. Typically, the information we share is provided through cookies or similar tracking technologies.
The only way to completely "opt out" of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or mobile device. Please refer to your browser's or mobile device's technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. To learn more about cookies, clear gifs/web beacons and related technologies, you may wish to visit and/or the Network Advertising Initiative's online resources, at http://www.networkadvertising.org. If you access our service on your mobile device, you may not be able to control tracking technologies through settings.
We will retain your information for as long as your account is active or as needed to provide you services. If you wish to delete or anonymize your User Content or Personal Information, please see the section below regarding "Methods of accessing or controlling your information" for more details.
4. SECURITY AND STORAGE OF INFORMATION
DuoPeak cares about the security of your information and uses commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all information we collect and that we share with our service providers. However, no security system is impenetrable and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.
5. PERSONS UNDER THE AGE OF 13
The Service and its content are not intended for children under the age of 13. We do not knowingly collect or solicit any personal information from children under the age of 13 and we do not knowingly allow children under the age of 13 to register for or use the Service. Children under the age of 13 should not use our Service or send us any personal information about themselves at any time. In the event we learn that we have inadvertently gathered personal information from children under the age of 13, we will delete that information as quickly as possible. The Services may contain links to and from third party websites of our business partners, advertisers, social media sites, and our users may post links to third party websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. Please check the individual policies before you submit any information to those websites.
7. HOW TO ACCESS, UPDATE, AND MANAGE YOUR PERSONAL INFORMATION
Information we receive from a social networking site (“SNS”)
To manage the information DuoPeak receives about you from an SNS where you use our Services, you will need to follow the instructions at that site for updating your information and changing your privacy settings.
You can also manage certain aspects of information collection and use by going to the settings of your (mobile) device and reviewing the permissions of each application.
Methods of accessing or controlling your information
If you no longer want DuoPeak to make active use of your information, you may send an e-mail to firstname.lastname@example.org. Place "Delete My Account" in the subject line and include your first name, last name, e-mail address, and user ID number from which you access our Services (if applicable) in the body of the e-mail. IMPORTANT: If you do so, you will no longer have access to the game account or services associated with your account. Should you wish to delete your account, we also recommend disassociating your Facebook account from our mobile games and removing the game from your mobile device.
Please note that if you ask us to delete your account, you will no longer have access to the account, and all progress in the game and any unused virtual items will be lost and we will not be able to restore them in the future. We will respond to your request within thirty (30) days. DuoPeak may use your information unless and until you send DuoPeak such a request.
Please note that your information, for example those records pertaining to payments or customer service matters, may be retained for legal and accounting purposes. If you have sent or posted content on the Service, we may not be able to delete it.
European Countries Users’ Rights
If you are located in a country in the European Union, the European Economic Area, or Switzerland, you have certain rights in relation to the personal data we hold about you, which we detail below, and which are subject to exemptions under applicable data privacy laws. Some of these only apply in certain circumstances as set out in more detail below. We also set out how to exercise those rights. Please note that we may require you to verify your identity before responding to any requests to exercise your rights. We will respond to a request by you to exercise those rights without undue delay and at least within one month (although this may be extended by a further two months in certain circumstances). We may decline to process requests in certain circumstances, such as where requests are manifestly unfounded or excessive or requests that jeopardize the privacy of others.
This section applies only to California residents. It describes how we collect, use and share Personal Information of California residents in operating our business, and their rights with respect to that Personal Information. For purposes of this section, “Personal Information” has the meaning given in the California Consumer Privacy Act of 2018 (“CCPA”) but does not include certain de-identified or aggregated information, information publicly available in government records, or certain information excluded from the CCPA’s scope.
Your California privacy rights. Effective January 1, 2020, as a California resident, and upon your verifiable consumer request, you have the rights listed below. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

We will need to confirm your identity and California residency to process your requests to exercise your information, access or deletion rights. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
Response Timing. We aim to respond to a consumer request for access or deletion within 45 days of receiving that request. If we require more time, we will inform you of the reason and extension in writing.
Personal Information that we collect, use and share. We describe the sources from which we collect Personal Information and the business and commercial purposes for which we collect this information in Section 1 (INFORMATION WE COLLECT AND USE) and Section 2 (SHARING INFORMATION) above.
8. INTERNATIONAL TRANSFERS OF YOUR PERSONAL INFORMATION
As you are contracting for the Services with DuoPeak, which is a US company, any information you provide to us, or that we collect through your use of the Services that is necessary to provide you the Services, will be stored, processed, and transferred within, or to, the United States. As a result, your information could be accessed by foreign governmental authorities, or otherwise, in accordance with applicable local laws.
Please be aware that the US and jurisdictions other than the one in which you are located will not have the same data protection laws as your own jurisdiction.
